Termination of the Agreement

Termination is an important aspect of contracts. In the Netherlands, there is contractual freedom. This means that, in principle, everyone is free to determine the terms of the agreement. The question of how to terminate an agreement cannot, therefore, be answered in general, but must be examined individually.

In most cases, the agreement (or the applicable general terms and conditions) stipulates the conditions and the term that can be cancelled.

Duration Agreement

If it concerns a (long-term) agreement for an indefinite period in which no termination option has been stipulated, the agreement can in many cases still be cancelled on the grounds of reasonableness and fairness. However, this is usually not possible without consequences for the terminating party. Often a notice period must be observed and/or compensation paid to the other party.
