Contractual Freedom

In the Netherlands, freedom of contract applies. This means that the parties themselves can decide with whom they enter into a contract and what the content of this contract is. Of course, there are a number of mandatory legal provisions that a contract must comply with, but these provisions apply in particular when a weaker party (such as a consumer or tenant) is part of the contract.

For professional parties, who conclude a contract with each other, the freedom of contract extends very far. Parties determine themselves what they agree on and this is also binding between those parties.
