Commissioning Party

The commissioning party is the party that, on the basis of an assignment agreement (Article 7: 400 BW), gives the nomination to perform work to a contractor.

Obligations

Under the contract, the commissioning party has several obligations towards the contractor. For example, he or she is obliged to:

  • pay wages to the contractor; and
  • reimburse the expenses incurred by the contractor if these are not included in the wages.

Termination

The commissioning party can terminate the agreement at any time. However, in some cases – if reasonableness and fairness entail this – the party is liable for damages.
