Contractor

The contractor is the party that performs work for a client or in other words the commissioning party on the basis of a contract for services (Article 7: 400 BW).

Obligations

Under the contract, the contractor has a number of obligations to the client. For example, he or she is obliged to:

  • observe the care of a good contractor in his work. What exactly is meant by this depends on the circumstances of the case. It is clear, however, that the contractor may not “cut” the assignment;
  • follow instructions from the client;
  • keep the client informed of his activities; and
  • immediately inform the client when the assignment has been completed.

Termination

The contractor may only terminate the agreement if there are compelling reasons for this.
