‘Termination’ is an act in contract law that aims to end the agreement. There are several ways in which an agreement can be terminated.
How can the Agreement be terminated?
The principle of freedom of contract applies in the Netherlands. This means that the parties are in principle free to determine the conditions of an agreement themselves. The duration of the agreement and the manner in which it can be terminated can also be freely determined by the parties. This freedom for parties does, however, not apply to a number of special agreements determined by the legislator, such as the lease and the employment contract.
In general, agreements can be terminated in four ways: by performance, cancellation, dissolution or destruction.
