Provisionally Enforceable

If a judgment has been declared “provisionally enforceable”, the judgment can be executed immediately, regardless of whether an appeal is still open. Appeals, therefore, have no consequences for the execution of the judgment.

In his claim, the claimant must explicitly demand that the judgment will be declared as “provisionally enforceable”. In principle, the judge cannot declare this by himself (ex Officio).
