A mandate agreement in which one party, the agent, commits itself to perform legal acts for the agent, towards the other party, the principal, is called a mandate.

Difference by the power of attorney

At first glance, a mandate seems to be given a power of attorney. However, there is an important difference. In the event of a mandate, the proxy holder is obliged to perform the legal acts. The proxy is, however, not obliged to do so but only authorized.
