Electronic-Communication-Data

Electronic communication data is a term from the ePrivacy Regulation. It includes both the content of electronic communication and metadata (data about the electronic communication data) and additionally both the (old) concepts of traffic data and location data.

Electronic communication data can contain personal data and can, therefore, be very sensitive. Think of information about social relationships, daily habits, activities, interests, tastes and so on. However, it can also include information about legal entities, such as trade secrets or other valuable information. The content of electronic communications data may be contained in text, speech, video, images and sound. Metadata concerns data such as numbers called, websites visited, geographical locations, time, date and duration of a call.

The main rule in the EPV is that electronic communications data is confidential. Any interference (or processing), such as eavesdropping, tapping, storing, checking, scanning or otherwise intercepting, checking or processing is in principle prohibited. This is unless the EPV allows an exception. For example, you may be allowed to process electronic communications data if this is necessary to establish the transmission of the communications, or if it is necessary for the security of the networks and services.
