Adaption

Article 13 of the Copyright Act specifies that a reproduction also includes any complete or partial adaptation or imitation in a modified form, as a result of which no new original work is created.

Criteria

To determine whether an adaptation should be regarded as reproduction or as a new original work there are criteria. This will be assessed on the basis of a possible takeover of the copyrighted features, the nature of the work and the overall impressions of the work.
