The burden of proof implies the obligation to prove statements. The main rule is laid down in Article 150 DCCP. This article states that the person who makes a claim will have to prove this statement.
Reverse Burden of Proof
In a number of cases, a reversed burden of proof has been chosen. A reversal of the burden of proof may result from a special rule or according to standards of reasonableness and fairness. An example of this is the employer’s liability: The employer is liable for damage that the employee suffers during the work unless he can demonstrate that he has fulfilled his obligations or that the damage is the result of intent or deliberate recklessness on the part of the employee.
