Binding Advice

Binding advice is a form of SGOA in which the parties agree to seek advice from an independent third party. The parties agree in advance in an agreement that they will comply with this advice. This agreement is actually a settlement agreement, whereby it is established that the advice is binding.

Examples

In ICT conflicts, SGOA is a well-known party that issues binding advice. Another well-known example of binding advice is the “judgment” made by the driving judge in the television program of the same name. Technically, this is not a statement, but binding advice.
