Cassation

Cassation is an appeal to the Supreme Court against a judgment of a court or a court of appeal. Often this will be a decision of a court of justice. Nevertheless, there are sometimes cases where a decision of the court against which an appeal has been lodged comes directly before the Supreme Court.

In cassation, in principle, the case is no longer determined based on the facts of the case. The Supreme Court is not a judge of facts anymore. It is only being checked whether the legal rules have been correctly applied to the factual complex.
