Choice of Forum

In international legal relationships, the question is always which judge has the competency to hear a dispute between parties. One way to designate the competent court is through a choice of forum. This choice of forum has often been laid down in a “choice of forum clause”. This is a contractual provision that designates the court that has jurisdiction to hear the dispute between the parties. If no choice of forum has been made, the competent court will be appointed on the basis of the rules of private international law.
