Computer Trespass

Intentional and illegal entry into a computer system is often referred to as hacking. Another name for the aforementioned is computer trespass. This is a crime and it is punishable under Article 138ab paragraph 1 of the Criminal Code.

Examples from the Law

There is no limited list of what may or may not be understood by computer trespass. The law, however, gives four examples of what is included below. There is a breach of the computer if access is obtained:

a. by breaking through security;
b. by technical intervention;
c. using false signals or a false key; or
d. by assuming a false quality.
