Defect of Consent

A defect of consent exists when the intention to enter into a legal contract with one of the parties involved would not have existed under normal circumstances.
Four Circumstances
The Civil Code (BW) distinguishes four circumstances that can lead to a defect of consent:
- threat;
- fraud;
- abuse of circumstances; and
- error.
Destructible
If one of these circumstances arises, the legal action is avoidable.
