European Order for Payment

The European order for payment makes it possible within the European Union to recover an undisputed claim on a foreign debtor through the courts. This order for payment can be requested via a court procedure in which parties, however, do not have to appear in court.

Procedure

The procedure for the European order for payment is as follows.

First, a request must be submitted to the competent court using a standard form. The court then decides on this request, without calling on the debtor. If the court decides to issue the European order for payment, the debtor will be given the opportunity to pay the amount due or to lodge a defence. If a defence is lodged by the debtor, the procedure changes into normal legal proceedings at the competent court.
