Jurisdiction

Not all judges are empowered to decide on all disputes. One of the requirements is that the dispute must fall under the jurisdiction of the judge.

In the summons procedure, the main rule is that if the defendant has his domicile or habitual residence in the Netherlands, then the Dutch court has jurisdiction. Jurisdiction of a particular judge may also be contractually agreed between the parties.
