Trademark Law

A trademark is a sign used to indicate goods or services in economic traffic. A brand can be a logo, name or another distinguishing mark of a company, commercial organization, product or service. Trademarks can be registered as a wordmark or logo. You can register and protect a trademark at the Benelux Office for Intellectual Property (BOIP). Your company or organization can do this itself, but it can also be done through a trademark lawyer or trademark attorney. Registration provides trademark protection.

Rights of the Trademark Holder

A trademark owner can act with a registered trademark against infringement of his trademark. A trademark right protects against the unauthorized use of a sign similar to the brand or the same as the brand when used for the same or similar products or services. Using a brand name without permission can, therefore, violate trademark rights.
