The person who has suffered a breach of contract or a wrongful act is entitled to compensation. It is, however, possible that part of the damage is caused by the injured party’s “own fault”.

Reduction in Compensation

In the event of personal negligence, the compensation is in principle reduced by the amount attributable to the behaviour of the injured party himself.

Such a reduction on the basis of personal negligence is a regular occurrence in road accidents where both parties have made a mistake.
