Product Liability

The producer is responsible for the safety of his or her product. If a product is defective and causes damage, the producer is liable for this. This is called product liability.

Not Liable

In some cases, the producer is not liable for a defective product, namely if:

  • the producer has not put the product into circulation;
  • the defect arose later than the moment when the producer put it into circulation; or
  • the producer could not identify the defect with the technical knowledge available during the production process.
