Purchase of Software

In addition to, for example, the increasing popularity of SaaS (Software-as-a-Service), the software can also be “just” licensed. Software is not a matter (a physical and human-controlled object), which means, among other things, that in principle, the software cannot be “bought”. Legally, only the purchase of goods is possible.

In 2012, however, the Supreme Court ruled that some licenses on software are comparable to the “purchase” and that the legal provisions of purchase apply to them.
