A defendant who has been convicted in absentia can object to this. The objection must be initiated by the service of the right of opposition. The defendant must defend himself against the claim in the notice of opposition.

Deadline

In principle, the period within which objection must be lodged is four weeks after:

  • service of the judgement in absentia;
  • service of a document in connection with the enforcement of the judgment; or
  • the commission by the person convicted in absentia of an act which shows that he is aware of the judgment or its execution.
