The subpoena is a written appeal to appear before a certain judge at a specific time. The summons begins with the subpoena.
Content of the Subpoena
The text of the civil subpoena contains in detail what is required by the claimant. The claim may include a sum of money, a prohibition or a certificate of entitlement. Furthermore, this claim must be substantiated in the subpoena, the evidence available to the claimant must be included in the subpoena, and it must be stated why the accused party is being sued. If the defendant has already raised a defence in the extrajudicial phase, this must also be stated in the summons.
Service of the Subpoena
The subpoena is issued by a bailiff personally to the defendant or delivered to the correct address. This is called service of the subpoena. This ensures that the defendant has received the subpoena.
