Third Party Attachment

A seizure may be placed on assets held by the debtor. However, it is also possible to seize assets held by a party that is outside the legal relationship between the creditor and the debtor. This is then called a third-party attachment.

Examples

Examples of the third-party attachment are the attachment of the debtor’s bank account or the debtor’s wages. The attachment is then levied respectively on the debtor’s bank or employer.

Paying liberally

If a third-party attachment has been levied, the third party has made a liberating payment to the debtor by direct payment to the creditor.
