“Whether it is copyright, trademark or trade names: IP disputes essentially come down to one question: “Is it too much alike?”. There is always some subjectivity, and therefore relatively much room for the lawyer to pull the case off in the right direction based on argumentation and persuasion. ”

What is a Persistent Misunderstanding about Internet Law?

” ‘If there is only one X number of demonstrable differences between the original and the later work or product, it does not infringe’. That ‘rule of thumb’ can go straight to the trash. Sometimes one difference is so prominent that it creates a completely different overall impression, and sometimes ten differences can be identified, but there is still an infringement.”

What do you like about the Legal Profession?

“Lawyers have a duty of confidentiality. I love that. Clients can tell me freely about their position and motives, without having to wonder whether that information has ended up in the wrong place. This gives me a very direct picture of what is going on at the customer and where the interests lie so that I can fully attune my advice to that. ”
